These Terms of Use (“Terms”) are a legally binding agreement between you and Tovia Team (“Tovia Team,” “we,” “us,” or “our”) governing your access to and use of the Tovia application and related services (collectively, the “Service”).
By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1) Eligibility (17+)
The Service is intended for users aged 17 and older. By using the Service, you represent that you are at least 17 years old and have the legal capacity to enter into these Terms.
2) The Service
ToviaLog helps you turn movie memories into an organized timeline. You can capture ticket stub photos, record memorable dates, write reviews and notes, and create watch summaries and curated collections to build a personal archive of your cinema experiences.
3) Accounts
You may need an account to use certain features. You agree to:
- provide accurate account information (such as name, username, and email),
- keep your account information updated,
- maintain the confidentiality of your login credentials,
- promptly notify us of any unauthorized use of your account.
You are responsible for activity that occurs under your account.
4) Your Content
4.1 Ownership
You retain ownership of the content you submit, upload, or store through the Service, such as photos, text, reviews, and notes (“User Content”).
4.2 License to Operate the Service
You grant Tovia Team a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, and display your User Content solely to provide, maintain, and improve the Service and as otherwise described in our Privacy Policy. This license ends when you delete the relevant User Content from the Service, except where continued storage is required for legal, security, or backup purposes.
4.3 Responsibility for User Content
You are responsible for your User Content and represent that you have all rights needed to upload it. You agree not to upload content that infringes intellectual property rights, violates privacy/publicity rights, is illegal, or is otherwise harmful.
5) Photo Processing and No Facial Recognition
If you upload photos (e.g., ticket stubs), you understand that the Service may process those photos to provide the requested functionality (for example, extracting text or generating an entry). The Service does not perform facial recognition and does not create biometric identifiers or templates.
6) Acceptable Use
You agree not to:
- use the Service for unlawful, harmful, or abusive purposes,
- attempt to gain unauthorized access to the Service or other users’ accounts,
- interfere with or disrupt the Service (including by introducing malware),
- reverse engineer, decompile, or attempt to extract source code from the Service except where such restriction is prohibited by law,
- use the Service to harass, threaten, or violate the rights of others.
7) Privacy
Your use of the Service is subject to our Privacy Policy, which describes how we collect, use, and share information. Please read the Privacy Policy carefully.
8) Third-Party Services
The Service may rely on or integrate with third-party services (for example, infrastructure providers). We are not responsible for third-party services not controlled by us. Your use of third-party services may be subject to their own terms.
9) Changes, Suspension, and Termination
We may modify, suspend, or discontinue the Service (in whole or in part) at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service, users, or Tovia Team.
You may stop using the Service at any time. You may request account deletion as described in the Privacy Policy.
10) Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
11) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOVIA TEAM WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO TOVIA TEAM FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM (OR USD $10 IF YOU HAVE PAID NOTHING).
12) Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Tovia Team from and against claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your User Content, your use of the Service, or your violation of these Terms.
13) Governing Law and Dispute Resolution (Binding Arbitration)
These Terms are governed by the laws of the jurisdiction where Tovia Team is primarily established, without regard to conflict of laws principles.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved through binding arbitration on an individual basis, except that either party may seek injunctive or equitable relief in a court of competent jurisdiction for disputes related to intellectual property, unauthorized access, or security.
14) Changes to These Terms
We may update these Terms from time to time. We will update the “Effective Date” above when changes are made. Your continued use of the Service after changes become effective means you accept the updated Terms to the extent permitted by law.
